The College of Law and Political Science at the University of Kirkuk witnessed the defense of a Master’s thesis titled: “The Legal Regulation of Oversight on Licensing and Practicing Commercial Agency Operations – A Comparative Study”
The thesis was submitted by the researcher, Alaa Medhat Obeid, and the defense took place at Hammurabi Hall within the college premises.
The examination committee was chaired by Asst. Prof. Dr. Radhwan Hashim Hamdoon (University of Al-Hamdaniya / College of Law), with the membership of:
- Asst. Prof. Dr. Mohanad Hamad Ahmed (University of Kirkuk / College of Law and Political Science)
- Asst. Prof. Dr. Ahmed Mohammed Qader (University of Kirkuk / College of Law and Political Science)
- Prof. Dr. Raed Ahmed Khalil (University of Kirkuk / College of Law and Political Science) – Member and Supervisor.
The thesis aimed to clarify the conceptual framework of commercial agencies, define their legal nature, and distinguish them from similar legal systems. Furthermore, it examined the oversight exercised by the competent authorities responsible for granting licenses to practice commercial agency activities and analyzed the effectiveness of the current legislative regulation in this field.
Key Findings: The study reached several significant conclusions, most notably that actions performed by a commercial agent during the ninety days following the expiration of the contract are deemed legitimate. This is based on the provisions of Article (8/IV) of the Iraqi Commercial Agency Regulation Law No. 79 of 2017.
At the end of the session, the thesis was approved following the incorporation of scientific observations. The committee praised the researcher’s efforts, as well as the value and significance of the topic in advancing legal studies related to the regulation of commercial activity in Iraq.
